The 9th Circus Court of the Ridiculous
is Out'a Control Also!
(Along with Congress)
June 6, 2007
Hello, Folks;
Well, D-Day is an appropriate day to tell you about the war that the Government is waging against Americans through the use of the federal judiciary.
A lady by the name of Marion Hungerford suffers from a severe mental illness bordering on schizophrenia. At the age of 52 years, she became involved with a guy named Dana Canfield. The two of them robbed seven convenience stores in Montana.
Canfield used a gun which Hungerford never touched, held,or brandished, nor did she go into any store to assist in the robbery. Her involvement was minimal in that she helped plan the heists and shared in some of the money Canfield stole.
The two were prosecuted federally under the Hobbs Act, 18 USC §1951 and 1952, and for the gun, 18 USC §924 (c)(1) and (c)(2).
Canfield took a plea and was sentenced to 32 years in prison, even though no one was injured in the robberies.
Ms. Hungerford, believing that she was innocent of the gun charges, and had other mitigating factors, chose to go to trial.
Now, Folks, here is where it really gets bizarre. She was convicted of all charges. The Prosecutor, by the way, was none other than the notorious James E. Seykora, the shark that was the hatchet man in the prosecution of LeRoy Schweitzer and the Montana Freeman group, back in the late 1990's.
The Judge, Richard F. Cebull, Jr., sentenced Ms. Hungerford to an outrageous 159 year sentence.
See 465 F.3d 1113 (9th Circuit 2006)
She appealed. The 9th Circuit upheld the sentence on the grounds it was merely following the orders of Congress.
Remember the prosecutions of the WW II Nazis in Nuremberg? They all said "Ve vas only following orders!".
It is not like Ms. Hungerford was some type of criminal with a bad record. She had no criminal behavior in the 52 years before her mental condition overwhelmed her ability to exercise discretion.
On appeal, to the 9th Circuit, Judges REINHERDT, GRABER and LEW, affirmed the sentence. REINHARDT, in what appears to be a thinly veiled attempt to assuage his conscience, wrote a concurring opinion full of apologies and explanations as to why the 9th Circus had to follow the mandate of Congress's mandatory minimum scheme, and blames the prosecutor for her Draconian sentence. Bullshit! Nonsense! Ridiculous! Specious!
Folks; If this doesn't make you sick and tired of the out-of-control Congress and Star Chamber federal courts, you have no heart, no soul, and no conscience.
This is exactly why you should immediately join the No Vote Party and encourage everyone you know to do so. Anyone who votes in the next election is a traitor to what the Founding Fathers put together for our nation, as well as insulting those who died trying to protect what we are supposed to hold dear in terms of Liberty, Justice, and the American way of life.
It is long past time we toss Congress and the federal judiciary and prosecutors who perpetrate these outrages out on their collective butts.
Do your part for America and join the No Vote Party today!
