The 5th Circus Enters the Arena of Excess
June 30, 2007
Hello, Folks;
In the case of U.S. v. Valles, 484 F. 3d 745 (5th Circuit 2007) we can see more of what I have repeatedly characterized as the immoral and unsustainable excesses on the part of the federal judges.
Mr. Valles was part of a drug related criminal conspiracy of a bunch of Mexicans who formed a group named the Texas Mexican Mafia. So is Mr. Zavala, his co-conspirator.
As before, I will restate that I am not soft on crime. I do, however, think that there must be some sort of balance struck in dealing with crime.
In this case, the District Court, run by Judge Orlando L. Garcia, engaged in extreme political rhetoric to demonize the group and inflame the jurors, in order to justify its sentencing scheme. The sentence was upheld by the 5th Circus clowns KING, WIENER, and OWEN.
There appears a number of procedural errors, all of which the clowns found harmless...yeah, you bet.
What it boils down to is that the Probation Officer's report set the sentence, and GARCIA simply added in his own extra enhancements to sentence Valles to 660 months (55 years), Zavala to life plus 60 months (what is the B.O.P. supposed to do? Keep his corpse on ice for five years after he dies?) and an additional consecutive 300 months (absolutely ridiculous) and two other co-conspirators each to 660 months.
As I have said before, if these people fight among themselves, so be it. Attrition will eventually take care of the societal problem. The taxpayer should not be burdened with the prospect of carry the burden of keeping these people in prison for the 55 years plus, and the enormous costs of prosecuting them. Does District Court Judge GARCIA think that laying these Draconian sentences on the group will in any way impact the level of crime in drug related activities in Texas? If he answers "Yes", he should be immediately committed to a mental institution. The D.O.J.'s own statistics clearly support the unalterable conclusion that despite the much vaunted and enormously expensive "War On Drugs", drug activities is at an all time high.
This is yet another example as to why you should join and support the No Vote Party and clear out all these so-called representatives of the People. These government programs have failed miserably to do that which they were supposedly designed to do.
In the real business world, people whose performance emulate the type of results for cost frameworks that the government programs show would be summarily fired. Why don't we do the same.?
